Plain reading: Beilume Glow is a color and lighting planning app that runs on your device. These terms explain what you may do with it, what you own, and what we are and are not responsible for. Please read them; using the app means you agree to them.
Agreement to these terms
By downloading, installing, or using Beilume Glow (the "App"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the App. "We", "us", and "Publisher" refer to Chloe Ward, the individual who publishes the App.
You must be old enough to enter into a binding agreement where you live, or have a parent or guardian's permission.
Your license to use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, subject to these terms and the rules of the app store you obtained it from. You may not copy, modify, distribute, sell, rent, reverse engineer, or decompile the App, except where the law expressly permits it.
Your photos, scenes, and notes
Everything you create in the App belongs to you: rooms, extracted palettes, cues, scenes, notes, and schedules. Photos you take or select stay on your device and are used only to extract colors. We do not receive, store, or claim any rights in your content.
Because content lives only on your device, you are responsible for keeping it. Deleting a scene, deleting a room, choosing Reset Everything, or uninstalling the App permanently removes that content and we cannot recover it.
The App is a planning tool
Beilume Glow helps you think through how light and color move through a space. Color extraction, luminance calculations, blends, part-of-day estimates, and scheduling are provided as creative aids. Colors on your screen will differ from printed, painted, or emitted light, and luminance values are approximations.
- The App is not a substitute for professional lighting, electrical, or interior design advice.
- If you connect the App's output to any lighting hardware or third-party system, you do so at your own risk and under that system's terms.
- Scheduled scenes depend on your device being on, the App being permitted to run, and your device clock being correct.
Acceptable use
You agree not to use the App in a way that breaks the law, infringes someone else's rights, or interferes with the App's operation. In particular you will not photograph material you do not have the right to photograph, attempt to bypass App security, or use the App to create content that is unlawful.
Ownership of the App
The App, including its code, design, icons, name, and the "Beilume Glow" mark, is owned by the Publisher and protected by copyright and other intellectual property laws. These terms do not transfer any of those rights to you. Feedback you send us may be used to improve the App without obligation to you.
Updates and changes
We may release updates that add, change, or remove features. We may also update these terms. If we do, we will change the effective date above and, for material changes, note it in the App's release notes. Continuing to use the App after a change means you accept the updated terms. If you do not accept them, stop using the App and delete it.
No warranty
The App is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of color or luminance values, and non-infringement. We do not promise the App will be error-free, uninterrupted, or that a scheduled scene will run at the exact moment you expect.
Limitation of liability
To the fullest extent permitted by law, the Publisher will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, scenes, photos, or profits, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid for it in the twelve months before the claim, or ten US dollars if you paid nothing.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Termination
You may stop using the App at any time by deleting it. We may suspend or end your license if you breach these terms. Sections 3, 6, 8, 9, and 11 survive termination.
Governing law and disputes
These terms are governed by the laws of the jurisdiction in which the Publisher resides, without regard to conflict-of-law rules, except where the mandatory consumer protection laws of your country give you additional rights. Before starting any formal dispute, please contact us so we can try to resolve it informally.
